Special prosecutor named to look into Jussie Smollett case

CHICAGO (AP) | A judge appointed a special prosecutor on Aug. 23 to look into why the Chicago state’s attorney’s office abruptly dropped the case against Jussie Smollett, leaving open the possibility that the former “Empire” actor could yet face charges in what police say was a phony attack on himself that he staged to get attention.

Smollett maintains that he was the target of a racist and homophobic attack in January. But if the special prosecutor, former U.S. Attorney Dan Webb, determines that the charges shouldn’t have been dropped, he could recommend that they be reinstated or that new charges be brought.

Smollett’s Jamal Lyon, who last season married Kai (Toby Onwumere), will be away on his honeymoon when the Fox drama returns Sept. 24 for its sixth and last season, Fox Entertainment CEO Charlie Collier said Wednesday.

CHICAGO (AP) | Jussie Smollett wants the lawsuit that the city of Chicago filed against him moved from state court to federal court.

The motion filed July 3 and released to the media by Smollett’s representatives comes after the city sued the actor in April for the cost of investigating his allegations that he was a victim of a racist and anti-gay attack in downtown Chicago.

CHICAGO (AP) | A judge appointed a special prosecutor June 21 to investigate the decision by Cook County prosecutors to dismiss all charges against actor Jussie Smollett, who was accused of lying to the police by claiming he was the victim of a racist and homophobic attack in downtown Chicago in January.

Cook County Judge Michael Toomin suggested that the county’s state’s attorney, Kim Foxx, mishandled the Smollett case by appointing a top aide to oversee it after she recused herself.

Prosecutors in Cook County, Illinois have dropped all charges against “Empire” star Jussie Smollett. On March 14, Smollett was indicted by a grand jury on 16 felony counts of disorderly conduct for filing a false report. He pled not guilty.

Smollett was summoned to an emergency court hearing at 10:30 a.m. on Tuesday where State Attorney Kim Foxx told him that all charges against him had been dropped and his record expunged. Smollett forfeited his bond and the judge also granted a motion to seal the case from the public.

Lawyer Tina Glandian entered the plea on behalf of the 36-year-old actor during a hearing in Cook County Circuit Court after Judge Steven Watkins was assigned to oversee the case, including the trial.

CHICAGO (AP) | News that a grand jury had indicted “Empire” actor Jussie Smollett for allegedly lying to Chicago police about being attacked by two masked men may not have made much of a splash except for one thing: The lone felony count that Smollett had been arrested on last month had turned into 16.

The reasons Smollett is facing 16 counts rather than just one count of disorderly conduct — the felony in Illinois that people are charged with when accused of lying to police — are not fully explained in the indictment that a grand jury returned on March 7. But legal experts say indictments like that aren’t uncommon in Chicago, and there are some explanations as to how the grand jury could have arrived at the 16 counts, eight of them for Smollett’s comments to a police officer and eight others for what he told a detective.

Actor Jussie Smollett allegedly paid $3,500 to orchestrate a “bogus” hate crime because he was “dissatisfied with his salary” on the Fox series “Empire,” Chicago Police Superintendent Eddie Johnson said in a press conference on Feb. 21.

Smollett is charged with disorderly conduct for filing a false police report. He was taken into custody early morning on Feb. 21.
