Woman fights DMV for right to take wife’s name

COLUMBIA, S.C. (AP) – Another lawsuit has been filed over South Carolina’s same-sex marriage ban.

Attorneys for a Lexington County woman filed the lawsuit Oct. 24.

Julie McEldowney says she legally changed her name with the Social Security Administration after marrying her wife in the District of Columbia earlier this year. But the South Carolina Department of Motor Vehicles has rejected applications to have her married name on her driver’s license.

South Carolina hasn’t responded in court. Probate judges in some South Carolina counties began taking applications for same-sex marriage licenses earlier this month after the U.S. Supreme Court’s refusal to hear a challenge to a decision by a federal appeals court with jurisdiction over South Carolina.

The state Supreme Court put those licenses on hold pending the outcome of an already ongoing ban challenge.
