Supreme Court: Still no action on DOMA

UPDATE: The court has rescheduled the marriage equality cases for consideration at the Judge’s Conference this Friday morning, Dec. 7. That means an announcment could come later Friday (right after the session) or on the following Monday.

The U.S. Supreme Court has released orders from its conference on Friday, and that list did NOT include DOMA, Prop. 8 or any of the other eight cases addressing same sex marriage. It looks like the next time the cases will be up for discussion will be Dec. 7, with an announcement that day or Dec. 10.

This, according to the SCOTUSblog:

The Court asked the U.S. Solicitor General for the federal government’s views on Law v. Siegel (docket 12-5196), a case dealing with the power of a bankruptcy trustee to impose on the debtor a special charge, and for other sanctions, for failing to comply with the trustee’s demands for information during discovery.  That is a case from the Ninth Circuit Court, where the Circuit panel upheld a “surcharge”on the debtor’s estate and set a discovery sanction on debtor Stephen Law, a Californian.

The Court did not grant any new cases, beyond the two that were announced last Friday.   Justice Sonia Sotomayor filed a length dissent from the Court’s denial of review in a Kentucky murder case, Hodge v. Kentucky (11-10974).

In addition, the Court refused to ruled on a claim that a jury, not a judge, must find the facts that support transferring the case of a juvenile accused of murder from juvenile to adult court, leading to greater punishment.  The case is Villalon v. Indiana (11-1324).
